Eligibility: The Sweepstakes is open to legal residents of the U.S., Puerto Rico and Canada (excluding Quebec), who are 13 or older as of date of entry. Employees of Aéropostale, Inc. (“Sponsor”), Don Jagoda Associates, Inc. (“Administrator”), their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies (collectively “Promotion Entities”) and the immediate family members (spouses, parents, children, and siblings and their spouses) and household members of each, are not eligible to participate or win. Void in Quebec and where prohibited by law and subject to all federal, state. provincial, municipal and local laws.
How To Enter The Sweepstakes: There are two ways to enter. ONE: Via text messaging: During the Sweepstakes Period, using your cellular phone or a two-way text-messaging device (collectively, the "Device"), text the short code “jeans” to 77982. Once you have sent the text, you will need to reply to a message verifying your eligibility (per these rules) and then you will receive a confirming text message and will receive one (1) entry into that day’s (as defined below) and all subsequent days’ (if any) Daily Prize random drawing. Entrants will be charged according to their carrier’s standard message and data rates and entrants should contact their carrier for pricing plans and details. Text-messaging may not be available through all wireless carriers or accessible in all areas. All text entries must be completed and submitted by 11:59:59 p.m. ET on August 19, 2012 to be eligible for the final Daily Prize random drawing. TWO: Via the mail (no purchase/text messaging necessary to participate): During the Sweepstakes Period, you may enter by hand printing your full name, date of birth, email address and phone number on a plain 3" x 5" piece of paper. Mail your entry in a hand-addressed stamped envelope to: Aéro Jeans for a Year Sweepstakes, PO Box 7849, Melville, NY 11775-7849. Mail-in entries must be postmarked by August 20, 2012 and received by August 27, 2012 to be eligible for the final Daily Prize random drawing. You will receive one (1) entry into the day (as defined below) and all subsequent days’ (if any) Daily Prize random drawings that your mail-in entry is postmarked on. Limit one (1) entry per person is permitted, regardless of method of entry. Entries will be carried forward to subsequently Daily Prize random drawings, if any. For the purposes of this Sweepstakes, a “day” is defined as beginning at 12:00:01 a.m. ET each day and ending at 11:59:59 p.m. ET each day. Multiple entrants are not permitted to share the same Device/phone number/email address. Normal phone/usage/subscription access charges imposed by your phone service provider will apply. All entries must be complete to be eligible. All entries become property of the Sponsor and will not be returned.
Sweepstakes Random Drawings: One (1) potential Daily Prize winner will be selected for each day of the Sweepstakes Period, beginning weekdays, August 7, 2012 through August 28, 2012 in separate random drawings from among all eligible entries received/postmarked by the end of each day. Drawings for Saturdays and Sundays will take place on Mondays. Entries postmarked on Saturdays will also be included for Sunday drawings and all subsequent days’ drawings. The random drawings will be conducted by the Administrator, an independent judging organization whose decisions are final on all matters relating to the Sweepstakes. The odds of winning a Daily Prize will depend on the number of eligible Sweepstakes entries received/postmarked by the end of each day.
Twenty-One (21) Daily Prizes [one (1) for each day] and Approximate Retail Value (“ARV”): Jeans for a Year, awarded in the form of twelve (12) coupons redeemable at any Aéropostale store. The ARV of each Daily Prize is USD$575. The Daily Prizes will be awarded and the winners will be notified by phone, mail and/or e-mail. If winner is a minor in his/her state/province of residence, prize will be awarded in the name of parent or legal guardian. Prizes are not transferable. Prizes and prize components may be substituted for any reason at the discretion of the Sponsor. Taxes, as applicable, related to the prize are the responsibility of the individual winner or parent/legal guardian. All other expenses and costs not expressly listed above are the winner’s sole responsibility. Coupons are subject to restrictions and an expiration date may apply.
Prize Redemption: Each potential Daily Prize winner will be notified via phone, email and/or mail. Daily Prize winners (or a winner’s parent/legal guardian if winner is under the age of majority in his/her state/province of residence) (a “minor”), will be required to verify their mailing address or prize will be forfeited and an alternate winner will be selected. Additional proof of eligibility may also be required at Sponsor's sole discretion.
If potential Grand Prize winner is not reachable at the phone number, address and/or e-mail address provided and a forwarding address and/or e-mail address is not made available or if prize notification is returned as undeliverable, then the prize will be forfeited and an alternate winner will be selected, time permitting. Promotional Entities shall have no liability for any winner notification that is not received by the potential winner for any reason.
For Canadian Residents Only: Potential Daily Prize winners in Canada must correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question to be administered online or by mail, email or phone, as Sponsor determines.
General Rules: By participating in the Sweepstakes, entrants agree to be bound by these Official Rules and the decision of Sponsor and Administrator. Except where prohibited by law, entry constitutes permission to use each winner’s name, prize won, hometown and likeness for any advertising and publicity without additional compensation.
No refunds or credit for changes are allowed.
The Promotion Entities are not responsible for stolen, late, misdirected, damaged, incomplete, illegible entries; or for any entries that are lost for any reason including, without limitation, computer, telephone or human error. The Promotion Entities are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, mutilated, late, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any human error which may occur in the processing of the entries in the Sweepstakes or for any liability for damage to any Device system resulting from participation in, accessing or downloading information in connection with the Sweepstakes. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of an entrant, the authorized account holder of the Device used to enter will be deemed to be the entrant. “Authorized account holder” of a Device is the natural person in whose name the Device has been issued and to whom services are billed. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then the Sponsor reserves the right at its sole discretion to cancel, terminate or modify the Sweepstakes. In such event, Sponsor will award applicable prizes from among all eligible text-messaging and all eligible mailed entries received/postmarked by the end of each day prior to cancellation. Entries generated by script or bot are not eligible.
Use of Personal Information: By participating, where allowed by law, winners shall grant the Sponsor exclusive permission to use winners’ names, characters, photographs, voices, and likenesses in connection with promotion of this and other Sweepstakes and waive any claims to royalty, right, or remuneration for such use. By participating in the Sweepstakes, where allowed by law, each winner agrees that the Promotion Entities may use such information for marketing purposes, and may include the winner’s name in a publicly available winners’ list.
Release: By participating in the Sweepstakes, you agree that the Promotion Entities, will have no liability whatsoever for, and will be held harmless by you for, any liability for any bodily injury, loss or damages of any kind to persons, including death, and property, due in whole or in part, directly or indirectly, from entry creation, the acceptance, possession, use or misuse of the prize (if applicable), or participation in this Sweepstakes or participation in any Sweepstakes related activity. You hereby represent and warrant that you have read these Official Rules and are fully familiar with its contents.
Jurisdiction: The Sweepstakes shall be governed by and interpreted in accordance with the laws of the State of New York in the U.S. applicable to promotions fully carried out within New York within the U.S. Except where prohibited by law, any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' and/or experts’ fees; and winners hereby waive all rights to claim punitive, incidental and consequential damages and any other damages (including attorneys fees), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Winners acknowledge that no other party nor any agent or attorney of any other party has made any promise, representation or warranty whatsoever, express or implied, not contained herein concerning the subject matter hereof, to induce the winners to execute any document and winners acknowledge that he/she has not executed any document in reliance on any such promise, representation or warranty not contained herein. Any waiver by the Promotion Entities of any term of any document in a particular instance shall not be a waiver of such term for the future. Winners agree that the invalidity or enforceability of any part of any document shall in no way affect the validity or enforceability of any of the remainder of that document.
